วันที่ 18 มกราคม 2567 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า ตามที่ได้เกิดอุบัติเหตุรถเครนสลิงขาดกระเช้าร่วงทับคนงาน ย่านถนนพระราม 2 ผมขอแสดงความเสียใจกับครอบครัวของผู้เสียชีวิตและห่วงใยผู้บาดเจ็บทุกรายจากเหตุการณ์ในครั้งนี้ ซึ่งทันทีที่ทราบข่าวผมได้รับรายงานจาก นายไพโรจน์ โชติกเสถียร ปลัดกระทรวงแรงงาน ว่าได้กำชับให้กรมสวัสดิการและคุ้มครองแรงงาน (กสร.) ร่วมกับสำนักงานประกันสังคม (สปส.) เข้าตรวจสอบข้อเท็จจริงเพื่อดำเนินการในส่วนที่เกี่ยวข้องตามภารกิจแล้ว พร้อมทั้งให้ความช่วยเหลือแก่ทายาทครอบครัวผู้เสียชีวิตด้านสิทธิประโยชน์ที่พึงได้รับตามกฎหมายแรงงานในทุกมิติ พร้อมเน้นย้ำให้นายจ้างปฏิบัติตามกฎหมายความปลอดภัยในการทำงานอย่างเคร่งครัด เพื่อป้องกันไม่ให้เกิดเหตุซ้ำรอยอีก
นายพิพัฒน์ กล่าวต่อว่า จากรายงานของสำนักงานสวัสดิการและคุ้มครองแรงงานกรุงเทพมหานครพื้นที่ 2 พบว่า เหตุการณ์ดังกล่าวเกิดขึ้นในวันนี้ (18 ม.ค.67) เวลาประมาณ 14.00 น.ได้เกิดเหตุเครนสลิงขาดกระเช้าร่วงทับคนงานเสียชีวิต สถานที่เกิดอุบัติเหตุตั้งอยู่ในพื้นที่ถนนพระราม 2 ซอย 72 แขวงแสมดำ เขตบางขุนเทียน กรุงเทพมหานคร จากการสอบถามข้อมูลเบื้องต้นเหตุเกิดขณะรถเครนกำลังทำงาน และจากข้อมูลเบื้องต้นมีผู้เสียชีวิต จำนวน 1 ราย บาดเจ็บสาหัส 1 ราย จากรายงานสำนักงานสวัสดิการและคุ้มครองแรงงานกรุงเทพมหานครพื้นที่ 2 ยังพบว่า ข้อกฎหมายที่เกี่ยวข้องกับกระทรวงแรงงาน ได้แก่ พระราชบัญญัติ ความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน พ.ศ.2554 มาตรา 8 ประกอบกฎกระทรวง กฎกระทรวงกำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการ ด้านความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานเกี่ยวกับงานก่อสร้าง พ.ศ. 2564 และกฎกระทรวงกำหนดมาตรฐานในการบริหาร จัดการ และดำเนินการด้านความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน เกี่ยวกับเครื่องจักร ปั้นจั่น และหม้อน้ำ พ.ศ. 2564
ทั้งนี้ จากรายงานของสำนักงานประกันสังคมกรุงเทพมหานครพื้นที่ 7 พบว่า มีคนงานเสียชีวิต 1 ราย ทราบชื่อคือ นายวิภาค พรหมประสงค์ อายุ 42 ปี และผู้บาดเจ็บสาหัส 1 ราย ทราบชื่อคือ นายธีรภัทร์ ขันนอก อายุ 24 ปี ถูกนำส่งโรงพยาบาลพีเอ็มจี อาการแรกรับศีรษะกระแทกพื้นไม่สามารถจำเหตุการณ์ได้ ขณะเกิดเหตุหมดสติต้นแขนซ้ายผิดรูป คิ้วขวาและขาซ้ายมีแผลฉีกขาด ซึ่งมีสิทธิได้รับเงินทดแทนตามพระราชบัญญัติเงินทดแทน พ.ศ. 2537 ได้แก่ กรณีเจ็บป่วยจะได้รับค่าทดแทนกรณีหยุดพักรักษาตัว ร้อยละ 70 ของค่าจ้างไม่เกิน 1 ปี และค่าทดแทนกรณีสูญเสียสมรรถภาพของอวัยวะ ร้อยละ 70 ของค่าจ้างไม่เกิน 10 ปี (กรณีมีการสูญเสีย) กรณีเสียชีวิต จะได้รับเงินค่าทำศพ 50,000 บาท รวมถึงค่าทดแทนกรณีเสียชีวิต ร้อยละ 70 ของค่าจ้างไม่เกิน 10 ปี และเงินทดแทนกรณีชราภาพ อย่างไรก็ตาม ขณะนี้เจ้าหน้าที่กำลังเร่งตรวจสอบข้อมูลและสถานะความเป็นผู้ประกันตนของผู้เสียชีวิตเพื่อดำเนินการดูแลให้ทายาทได้รับสิทธิประโยชน์ตามกฎหมายต่อไป
On January 18, 2024, the Labour Minister, Mr. Phiphat Ratchakitprakarn, spoke about the accident where a crane’s gondola fell on workers as it fell to the ground on Rama 2 Road. He expressed his condolences to the families of the deceased and cared for all those injured in this incident. As soon as he heard the news from the Permanent Secretary of Labour, Mr. Pairoj Chotiksetia’s report, he instructed the Department of Labour Protection and Welfare (DLPW) and the Social Security Office (SSO) to investigate the facts, to carry out their relevant duties and assist the families of the deceased regarding their eligible benefits. He emphasized that employers must strictly comply with occupational safety laws to prevent such incidents from repeating.
Mr. Phiphat continued that the report of the Bangkok Labour Protection and Welfare Office Area 2 found that the incident happened today (January 18, 2024) at around 14.00 hours. A crane had lost its gondola and fell on a worker, who died. The accident happened on Rama 2 Road, Soi 72, Samae Dam Subdistrict, Bang Khun Thian District, Bangkok. Based on preliminary inquiries, the incident occurred while the crane was working. There was one death and one serious injury. The report from the Bangkok Labour Protection and Welfare Office, Area 2, found that legal matters related to the Ministry of Labour include the Occupational Safety, Health and Working Environment Act B.E. 2554, Section 8, the ministerial regulations on specifying standards for administration, management, and operations regarding occupational safety, health, and working environment in construction work, B.E. 2554, and ministerial regulations specifying standards for administration, management, and operations regarding occupational safety, health, and working environment in construction work on work with machinery, cranes and boilers B.E. 2564.
The report from the Bangkok Social Security Office Area 7 found that the decreased worker’s name is Mr. Wiphak Promprasong, aged 42. The severely injured person is Mr. Teerapat Khanok, aged 24, taken to PMG Hospital. His head hit the ground, and he is unable to remember the event. At the time of the incident, he was unconscious, and his left upper arm was deformed. His right eyebrow and left leg had lacerations. The worker is eligible for compensation from the Workers’ Compensation Act B.E. 2537, namely in the case of illness, they will receive compensation for medical treatment at 70 percent of their wages for no more than one year and compensation in the case of a 70 percent loss of organ function at 70 of wages not exceeding ten years (in case of loss). In case of death, beneficiaries will receive funeral expenses of 50,000 Baht, including compensation in the case of death at 70 percent of wages for no more than ten years and old age compensation. Officials are urgently checking the information and insured status of the deceased to ensure that the beneficiaries continue to receive legal benefits.
